Terms of Service

By booking a tour or using the services of Explore Kibera Tours ("we," "us," or "our"), you ("you" or "the Guest") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not proceed with a booking. These terms apply to all tours, experiences, and services offered through our website, WhatsApp, or any other booking channel.

Deposits

A deposit of 30% of the total tour price is required to confirm your booking. The remaining balance is due 48 hours before the tour start time. For bookings made within 48 hours of the tour, full payment is required at the time of booking.

Payment Methods

We accept M-Pesa (Paybill), bank transfers, and major credit cards. Payment details will be provided upon booking confirmation.

Cancellation Policy

• 72 hours or more before tour: Full refund of all payments made.
• 24 to 72 hours before tour: 50% refund of the total tour price.
• Less than 24 hours before tour or no-show: No refund.

Refunds are processed within 7 business days via the original payment method. M-Pesa refunds are sent as B2C payments.

We reserve the right to modify or cancel tours under the following circumstances:

• Weather conditions: For safety reasons, tours may be adjusted or rescheduled due to severe weather. In such cases, we will offer an alternative date or a full refund.
• Safety concerns: If local conditions pose a safety risk, we may alter the itinerary. Safety is our top priority.
• Group size: Tours may be combined with other guests. Private tour exclusivity is guaranteed only if specifically booked as a private tour.
• Force majeure: We are not liable for changes due to events beyond our control, including natural disasters, political unrest, or public health emergencies.

As a guest, you agree to:

• Wear appropriate clothing and comfortable walking shoes for the tour.
• Respect local communities, their customs, and private property during the tour.
• Follow all instructions provided by your tour guide for your safety and the safety of others.
• Obtain explicit consent before photographing or filming community members, especially children.
• Carry any personal medications or items you may need during the tour.
• Inform us of any medical conditions or mobility limitations at the time of booking.

While we take every precaution to ensure your safety and enjoyment, Explore Kibera Tours shall not be held liable for:

• Personal injury, loss, or damage to personal belongings during the tour.
• Delays or cancellations caused by circumstances beyond our control.
• Actions or omissions of third-party service providers (e.g., transport operators).

Our total liability for any claim arising from a tour shall not exceed the total amount paid for that specific tour. We strongly recommend that guests obtain comprehensive travel insurance before the tour.

All content on our website, including text, images, logos, and tour descriptions, is the property of Explore Kibera Tours or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

Photos taken during our tours may be used by Explore Kibera Tours for marketing and promotional purposes. If you do not wish to be photographed, please inform your guide at the start of the tour.
